VIJAY COMMITTEE : NGOs
VIJAY KUMAR COMMITTEE was appointed by the central government, on the Orders of the Supreme Court, in response of the WRIT petition filed by Manohar Lal Sharma, in wake of recent Interfaces between NGOs and the government >Stand Off between NGOs and the government>complains of undue or targeted harassment by the government under the IT Act and FCRA.
It recommends for 'Light Regulations' to reduce their harassments. It recommends Registration procedures to be Modernised to facilitate Seamless Operations of the IT(Income Tax) Act and FCRA(Foreign Contribution Regulation Act) w.r.t NGOs. Steps must be taken to reduce Physical Interface between NGOs and Public Officials acting under the Acts and to reduce Mutual Distrust and Scope for Misuse.
Well construed Guidelines have been framed for Accreditation of NGOs, Audit of their Accounts and Actions for Recovering Grants in case of Misappropriation.
It recommends for a Nodal Body to oversee the Interfaces between NGOs and the government. NITI Aayog is to be vested with the Power. A separate Law should be framed for Voluntary Agencies.
Regulations should be 'Light and Consistent with the Fundamental Rights' .So that Objectives of Voluntarism would be Prompted. So would Strengthen Democracy.
